1. Introduction
Welcome to OceanStreamIsland ("we," "our," or "us"). These Terms & Conditions ("Terms") manage your usage of our yacht rental services and website located at oceanstreamisland.sbs (the "Service") administered by OceanStreamIsland.
By reserving a yacht or utilizing our Service, you consent to adhere to these Terms. Should you not agree with any section of these terms, you must refrain from using the Service.
2. Service Overview
OceanStreamIsland offers top-tier yacht rental solutions, which include but are not limited to:
- Full-day yacht leasing
- Sunset voyages
- Business retreats
- Exclusive events
- Extended charters
Services are available depending on vessel availability and climatic conditions. We retain the authority to alter or halt services without prior notice.
3. Booking and Reservations
3.1 Reservation Process
To reserve a yacht, one must:
- Be no younger than 18 years old
- Supply precise and comprehensive details
- Remit the requested down payment as indicated in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Reservation confirmation is contingent on the receipt of remittance and our subsequent written confirmation. We hold the prerogative to decline service at our discretion.
3.3 Charter Availability
Charter opportunities are contingent on vessel accessibility and appropriate meteorological conditions. We endeavor to accommodate your preferred schedule.
4. Payment Terms
4.1 Cost
All fees are presented in € and encompass all pertinent taxes unless specified differently. Costs are subject to alteration without prior notification.
4.2 Payment Timeline
- Initial deposit: 50% of the overall cost of the yacht charter due at the time of reservation
- Final balance: Payable 48 hours prior to the scheduled departure of the charter
- Incidental expenses (if any): Payable upon the charter’s conclusion
4.3 Methods of Payment
We accept a variety of payment methods including major credit cards, electronic bank transfers, and certified bank drafts. Transaction processing is conducted via secure, encrypted mechanisms.
5. Cancellation and Refund Policy
5.1 Client Termination
- If notice is given more than 72 hours before the departure: Complete reimbursement minus processing fees
- If cancellation occurs 24-72 hours before departure: Refund of 50%
- If the cancellation is made less than 24 hours before departure: No refund provided
5.2 Cancellations Due to Weather
Should our captain determine weather conditions as unsafe, we will propose:
- Rescheduling the charter to an alternative date without extra costs
- Issuing a full refund if rescheduling is unfeasible
5.3 Vessel Malfunction
In the case of mechanical issues with the allotted vessel, we will try to supply a suitable substitution. In the absence of a replacement, a full reimbursement will be offered.
6. Safety and Behaviour
6.1 Safety Obligations
All participants must:
- Obey all directions from the crew
- Utilize safety equipment as required
- Declare any health conditions that might influence their security
- Stay within specified areas on the vessel
6.2 Prohibited Articles
The following items are banned on board:
- Glassware
- Illicit drugs
- Weapons or firearms
- Excessive beverages (beyond reasonable quantities)
- Pets (unless pre-authorized)
6.3 Behaviour
Participants should behave in a manner that is respectful. We reserve the authority to terminate a charter in advance and without refund if a customer's actions constitute a safety hazard or distorts the experience for others.
7. Liability and Insurance
7.1 Our Responsibility
Our accountability is confined to the payment made for your charter. We are not liable for:
- Injuries sustained due to passenger carelessness
- Theft or destruction of personal belongings
- Indirect, incidental, or punitive losses
- Delays due to climate or events outside our control
7.2 Insured Protection
We carry comprehensive marine insurance for our fleet and operations. Passengers are accountable for their own travel and personal indemnity plans.
7.3 Risk Acceptance
Engaging in our yacht rental services indicates awareness that marine activities carry inherent dangers, and you assume liability for your own protection and well-being.
8. Changes to Itinerary
We maintain the authority to alter itineraries, paths, or schedules according to meteorological conditions, safety concerns, or operational needs. We will strive to provide appropriate alternative experiences.
9. Force Majeure
We bear no culpability for delays, cancellations, or amendments brought about by circumstances outside of reasonable control, inclusive of but not constrained to:
- Severe meteorological situations
- Natural catastrophes
- Legislative enactments
- Port obstructions
- Mechanical failures
10. Privacy and Data Security
Your private data is managed in concordance with our Privacy Policy. By utilizing our services, you acquiesce to the compilation and application of your data as detailed in our Privacy Policy.
11. Intellectual Property
All materials on our website, including but not limited to text, visuals, trademarks, and imagery, are protected under copyright and trademark statutes. Unauthorized duplication, distribution, or creation of derivative material without express permission is prohibited.
12. Applicable Legislation
The governing laws of France dictate these Terms. Any disputes are to be adjudicated in the judiciary of Antibes, France.
13. Revision of Terms
We hold the right to revise these Terms at any interval. Notifications of amendments will be announced on our website with a consequential update of the revision date. Continuation of service use implies acceptance of the adjusted terms.
